Commodity inspection is done in order to protectthe public interests and the awful rights andinterests of the parties involved in foreign trade. 维护社会公共利益和进出口贸易有关各方的合法权益而进行商品检验。

The significance of commodity inspection is topromote the smooth development of economic andtrade relations with foreign countries. 商品检验的意义在于促进对外经济贸易关系的顺利发展。

In what way can we do the inspection well? 如何做好商品检验？

Import-export commodity inspection should be done on the basis of human health andsafety, environmental protection and public safety. 进出口商品检验应当根据保护人类健康和安全、保护环境和维护公共安全为基础。

In order to protect the life or health of fauna and flora and prevent fraud, import-exportcommodity inspection is carried out. 进出口商品检验应当保护动物或者植物的生命和健康，防止欺诈行为。

Imported commodities which do not go through the inspection formality are not allowed tosell or use; exported commodities which prove to be disqualified in the process of inspectionare forbidden to be exported. 进口商品未经检验的，不准销售、使用；出口商品未经检验合格的，不准出口。

The import and export commodities which meet the conditions for exemption of inspectionprovided for by the State may be exempted from
inspection upon the examination andapproval of an application from the consignee or consignor by the State Administration forCommodity Inspection. 进出口商品中符合国家规定的免予检验条件的，有收货人或者发货人申请，经国家商检部门审查批准，可以免予检验。

A: The reinspection should be made within 5 daysupon the arrival, and if any discrepancy is found,claim must be raised within 10 days. However, if theclaims fall within the responsibility of shippingcompany, the underwriter shall not be entertained.
复检应该在货物抵达后5天内进行，如果发现任何差异，索赔必须在10天提出。但是，如果索赔内容是轮船公司应该承担的，保险公司是不会接受的。

B: I see. But when reinspection is made, can we appoint any authentic surveyor without yourapproval?

A: It's better to choose the inspection agency with both sides' approval in the contract.
最好选择合同中我们双方都同意的检验代理机构。

B: OK. Would you tell me how the inspection is conducted before shipment and by whichagency?

A: Inspection is to be done by the Commodity Inspection and Testing Bureau. Usually theinspection is conducted within 5 days before each shipment.

A: We'd like to have you help straighten out thetrouble concerning the bicycles.

A: We have here a copy of the inspection certificateissue by the Commodity Inspection Bureau and aset of photos. The inspection certificate states thatthe bikes were found rusty when they were unpackedand the photos taken on the spot back up the findings.
这是商检局开具的检验证明书副本和一组照片。检验证明书上说，开箱时发现自行车已经生锈，这些当场拍的照片能证明这点。

B: Are all our bikes like this?
我们的自行车都这样吗？

A: Not all, there are 5 of them that have rust stains.
不是全部，五辆有锈斑。

B: This is very unfortunate. Our manufacturer has always attached great importance to thequality of their products. But maybe the rust stains are due to dampness at sea. If that's thecase, the liablity should rest with the insurance people.
真是太不幸了。我们的厂家对他们的产品质量向来很重视，也可能这些锈斑是海上受潮造成的。如果那样的话，就应该由保险公司负责。

A: But our experts are of the opinion that the rust stain are not due to dampness but to poorworkmanship. Please look at the picture. They surely prove that the derusting of the bikesbefore plating was not thoroughly done.

B: Well, it seems that manufacturers have not lived up to their standard in this case.

A: On the strength of this evidence, the responsibility rest with the producer and not with theinsurance people. It's obvious that the manufacturers didn't strictly observe the proceedingrequirements as stipulated in our contract.

B: Well, I'm very sorry for this. We'll replace the defectively bikes with new ones.
